Privacy Guide for Youth

This section is for our younger visitors to help you understand how we use your info.

 

  1. What do we know about you?

 

If you fill out a WIX Form or sign up for our newsletter, we might ask you for your name and email address.  If you buy a ticket using TryBooking, we see your booking details so we can get you into the event!

 

  1. Why do we need this?

 

We only use your info to:

  • Answer your questions

  • Send you the updates you asked for

  • Make sure our website works properly for you

  • Keep you safe

 

  1. Who else sees your info?

 

We don’t sell or give your info to strangers.  We use a few trusted “helper” companies to run our site:

  • Wix: They host our website and help us see how many people visit.

  • TryBooking: They help us manage bookings.

  • Westpac: They help us make payments safely.

 

IMPORTANT: If we think you or someone else is not safe, we might have to tell a responsible adult who can help, like the police.

 

  1. Where is your info kept?

 

Because we use Wix and other global tools, your info might travel to safe computers in other countries, like the USA.  We make sure these computers have “digital locks” (encryption) to keep your info safe.

 

  1. You are in control!

 

  • Change your mind?  You can click “unsubscribe” on any email we send to stop getting them.

  • Want to see it or delete it?  Ask your parent or guardian to email us at support@quirkynotions.org and we can show you what information we have and/or delete it forever.

  • Cookies:  You’ll see a banner when you arrive.  You can say “No” to the trackers that watch what you click.

 

  1. A Note for Parents

We follow laws like COPPA (USA), the Children’s Code (UK/EU) and the Australian Privacy Code.  We don’t intentionally collect data from children under 18 without a parent’s help.  If you think we have info we shouldn’t have, please let us know!

QUIRKY NOTIONS THEATRE LAB PRIVACY POLICY Full Privacy Policy           

 

Quirky Notion Theatre Lab collects personal information solely to deliver safe, relevant programming and maintain clear communication. We may collect names, contact details, emergency contacts, IP, and sensitive health information required for participant safety.  Data is collected directly through online registration platforms. Our company is hosted on the wix.com platform.  We collect your email through our newsletter sign-up and other forms to send product updates, special offers, and maintain communication with you regarding goods and services, quote requests, and bookings.  When you fill out a form on our site, we collect personal information such as your name, email address, and phone number.  This data is stored securely in our Wix.com database to facilitate communication with you. It is also stored securely in our personal company records.  We take reasonable steps to protect this data from unauthorised access or disclosure.  We do not sell or distribute your data.  Information is only shared with third parties where strictly necessary for service delivery or safety.   

 

WHERE WE SHARE YOUR INFORMATION

 

We sometimes use TryBooking to manage our event registrations and ticket sales.  When you make a booking, your personal information (such as name, email, and payment details) is collected by TryBooking to process your transaction and provide booking confirmations.  Your data is stored securely by TryBooking in accordance with their Privacy Policy.  We do not store your full credit card details on our own servers; these are handled by TryBooking’s PCI-compliant payment partners.

 

We use Westpac EFTPOS Air to process in-person card payments. When you pay using this service, Westpac collects transaction and financial data to complete the purchase.  This data is encrypted during transit and is handled according to the Westpac Privacy Statement.  We do not store your credit card or sensitive payment details on our own devices or servers; all such information is processed securely by Westpac using industry standard security.

When you choose to pay via direct bank transfer, you will process this payment through your bank, and all information collected will be handled in accordance with your bank’s privacy policy.

 

We use Wix Analytics to understand how visitors interact with our website. This service automatically collects information such as your IP address, browser type, and browsing patterns on our site.  This data helps us measure site performance and improve our services.  All such data is stored securely on Wix.com servers.  You can manage your preferences for these non-essential cookies through our cookie consent banner.

 

CHILD PRIVACY PROTECTION

 

Quirky Notions Theatre Lab will only collect personal information about children when they are enrolled in one of our workshops or programs.  We will obtain verifiable consent from parents before collecting any personal information for all participants under the age of 18.

 

  • Collected information may include the following: name of child, age, date of birth, names of legal guardians, relevant health information, guardian’s email and/or phone number, and address

  • Parents may review, delete, or refuse further collection of their child’s data

  • Registration information will be collected and stored by third-party platforms, such as TryBooking or Wix, and the Quirky Notions Theatre Lab admin team.

  • You may contact the Quirky Notions team in one of the following ways:

  • Outside of booking registration, and with consent of a guardian, Quirky Notions Theatre Lab does not knowingly collect data from anyone under the age of 18.

 

MANDATED REPORTING AND SAFETY DISCLOSURES:

 

We are committed to the safety and wellbeing of all our participants, particularly children and vulnerable individuals.  Please be aware that our privacy and confidentiality obligations are subject to Australian “Mandated Reporting” Laws.

 

As an external service provider working with children and students, we have a legal and ethical “Duty of Care” to ensure the safety of all participants.  Under Western Australian law, including the Children and Young Persons (Care and Protection) Act, our staff act as Mandatory Reporters.

 

If we form a reasonable belief that a child is at risk of harm, or if a disclosure of abuse is made during one of our sessions or via our digital platforms, we are legally required to report this information to the Department of Communities (Child Protection) or the Western Australia Police Force.

 

In accordance with the Department of Education (WA) protocols, we will also notify the relevant School Principal or Child Protection Officer.  In these instances, your personal information may be shared without consent to ensure the immediate safety of the child.

 

IN-SCHOOL AND COMMUNITY ORGANISATION PROGRAM PRIVACY POLICIES

 

Quirky Notions Theatre Lab complies with the Privacy Act 1988 and the Australian Privacy Principles.  When providing services to a school, Quirky Notions Theatre Lab further agrees to adhere to the WA Department of Education policies regarding student privacy and data security.

 

Quirky Notions Theatre Lab will only collect student information that is strictly necessary for the safe delivery of the workshop.  Where possible, the school/organisation will provide de-identified data via an agreed upon code (i.e. Student A).

Student information is used solely for workshop delivery and safety.  Quirky Notions Theatre Lab will not disclose, sell, or use student data for marketing purposes without explicit, separate parental consent.

 

All personal information is stored on secure, password protected systems.  No student data will be stored on “offshore” cloud servers unless they meet Australian privacy standards.

In accordance with school auditing requirements, Quirky Notions Theatre Lab will securely destroy or return all sensitive student information within 30 days of workshop’s conclusion.

 

ADDITIONAL DISCLOSURES FOR CALIFORNIA RESIDENCE (CCPA/CPRA)

 

If you are a resident of California, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with specific rights regarding your personal information.

 

CATEGORIES OF INFORMATION WE COLLECT

 

In the preceding 12 months, we have collected the following categories of personal information:

 

  • Identifiers: Name, email address, IP address, and unique identifiers (collected via Wix Forms and Wix Newsletters).

  • Commercial Information: Records of tickets purchased or events attended (processed via TryBooking).

  • Internet Activity: Browsing history and interactions with our website (collected via Wix Analytics).

  • Geolocation Data: General location based on your IP address.

 

OUR USE OF PERSONAL INFORMATION

 

We use this information for business purposes, including processing your event bookings, sending requested newsletters, and improving our website performance. We do not "sell" your personal information for money. However, like many businesses, we "share" identifiers with service providers (like Wix) to run our site and show you relevant content.

 

YOUR CALIFORNIA RIGHT TO PRIVACY

 

You have the following rights:

  • Right to Know: You can request a list of the personal information we hold about you.

  • Right to Delete: You can request that we delete your personal information.

  • Right to Correct: You can ask us to fix inaccurate information.

  • Right to Opt-Out: You can opt-out of the "sharing" of your data for cross-contextual advertising by managing your preferences in our Cookie Banner.

  • Right to Non-Discrimination: We will not treat you differently or deny services if you choose to exercise these rights.

 

HOW TO EXERCISE YOUR RIGHTS

 

To make a request, please email us at support@quirkynotions.org with the subject line "California Privacy Request." We will verify your identity before fulfilling the request.

 

ADDITIONAL DISCLOSURES FOR RESIDENTS OF OTHER US STATES

 

If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, or other US states with comprehensive privacy laws, you have specific rights regarding your personal information.

 

YOUR PRIVACY RIGHTS

 

Depending on your state of residence, you may exercise the following rights:

 

  • Right to Access: To confirm if we are processing your personal data and to obtain a copy of that data.

  • Right to Correct: To ask us to fix any inaccurate or incomplete info we have about you.

  • Right to Delete: To request that we delete personal data provided by or obtained about you.

  • Right to Opt-Out: To opt-out of the processing of your data for (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling that produces legal or significant effects.

  • Right to Data Portability: To receive your data in a portable and usable format.

 

HOW TO EXERCISE YOUR RIGHTS

 

To submit a request, please email support@quirkynotions.org  We will respond to your request within 45 days. If we need more time (up to an additional 45 days), we will let you know why.

 

RIGHT TO APPEAL

 

If we decline to take action on your request, you have the right to appeal our decision. Please see our "Right to Appeal" section below for instructions on how to do this.

 

SENSITIVE DATA

 

We do not knowingly collect "Sensitive Data" (such as racial or ethnic origin, religious beliefs, mental or physical health diagnosis, or precise geolocation) without your prior opt-in consent.

 

 

ADDITIONAL DISCLOSURES FOR EU AND UK RESIDENTS

 

If you are located in the European Economic Area (EEA) or the United Kingdom, the General Data Protection Regulation (GDPR) gives you specific rights regarding your personal information.

We only process your data when we have a legal reason to do so. Our "Lawful Bases" include:

  • Contract: When you provide information via TryBooking or Wix Forms to enrol in a drama class or buy a ticket.

  • Legitimate Interests: To run our business, monitor site performance via Wix Analytics, and ensure our website is secure.

  • Legal Obligation: To comply with Australian Mandatory Reporting laws or tax requirements.

 

YOUR ENHANCED RIGHTS

 

Under the GDPR, you have the following rights:

 

  • Right to Access: You can ask for a copy of all data we hold about you.

  • Right to Erasure ("Right to be Forgotten"): You can ask us to delete your data forever (unless we have a legal reason to keep it, like tax records).

  • Right to Data Portability: You can ask for your data in a format that you can move to another service.

  • Right to Object/Restrict: You can ask us to stop using your data for certain things, like marketing.

  • Withdrawal of Consent: You can take back your permission at any time by clicking "Unsubscribe" or changing your cookie settings.

 

INTERNATIONAL DATA TRANSFERS

 

Our website is hosted by Wix.com, which is based in Israel (a country deemed "Adequate" by the EU). However, some of our service providers (like Westpac or TryBooking) operate in Australia. Because Australia is not currently on the EU "Adequacy" list, we ensure your data is protected using Standard Contractual Clauses (SCCs) or equivalent safeguards to keep your information as safe as it would be in Europe.

 

HOW TO COMPLAIN

 

If you aren't happy with how we handle your data, you have the right to lodge a complaint with your local Data Protection Authority.

 

PRIVACY POLICY UPDATES

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
